Based on a literature review, consultation with experts in the field, and onsite study of individual programs, this report outlines the roles which police, prosecutors, probation officers, and judges can perform to improve the handling of domestic assault cases. Following a discussion of the myths and assumptions associated with domestic violence, general recommendations cover the role of legislation and action steps for criminal justice agencies. Some action steps recommended are the designation of domestic violence cases as high priority, written policies for handling such cases, procedures to ensure employee compliance with written policies, the collection of separate data on domestic violence incidents, and interagency coordination in the handling of domestic violence cases. A chapter on the police role in domestic violence cases addresses written policies, the service call, arrest policy, the enforcement of protection orders, victim assistance, investigation, and training. A chapter with guidelines for prosecutors addresses the domestic violence unit, written policies, charge filing, pretrial release and diversion, plea bargaining, and victim support and protection. Another chapter covers trial procedures, sentencing options, and the role of probation officers following conviction. Other topics discussed are court-ordered counseling and education for batterers and community education and outreach. Appendixes contain various relevant materials from local criminal justice agencies.
